SCOTUS Case: Kansas v. Marsh, 04-1170

This is a death penalty case that has decided whether or not juries must decide for the death penalty only if the crime fits punishment. It was a five-four decision affirming Kansas' right to write it's own laws, as long as they remain constitutional. For a better review, please go to SCOTUSblog.
